Terms and Conditions of 123 Car Rental

 

These terms and conditions ("Terms") govern the use of the car rental services provided by 123 Car Rental, hereinafter referred to as "the Company." By using our services, you agree to abide by these Terms. Please read them carefully.

 

  1. Rental Agreement

- You must be at least 23 years old to rent a vehicle from 123 Car Rental.

- You are required to present a valid driver's license at the time of rental.

 

  1. Vehicle Usage

- The rental vehicle is for personal use only and should not be used for commercial purposes unless otherwise agreed upon.

- Smoking and the transportation of pets are strictly prohibited within the rental vehicles. Failure to adhere to these regulations will incur a deep cleaning fee of $500. This fee is applicable even in instances where the renter has purchased the 100% coverage package.

 

  1. Rental Period

- The rental period starts and ends as stipulated in the rental agreement.

- Please be aware that late returns will incur additional charges. For delays of up to 4 hours, there is a fee of $20 per hour. For delays exceeding 4 hours, an additional full day's rental charge will apply.

 

  1. Rental Rates and Payment

- Rental rates are based on the period of use (per 24 hours) and the type of vehicle selected.

- Payment for the rental, including any additional services or fees, is required in advance.

- Additional charges may apply for services such as fuel, insurance, and equipment rentals.

 

  1. Insurance and Liability

- Our rental vehicles come with a Collision Damage Waiver (CDW) insurance coverage. Additional a 100% Coverage Package is available for purchase.

- The renter is responsible for any damage or loss of the vehicle up to the amount of the deductible amount ($500 with CDW and $0 with the additional 100% Coverage Package).

- The Company is not liable for personal belongings left in the rental vehicle.

 

  1. Alcohol/Drugs or Speeding

Crucial Notice: Your Coverage is Extensive! Nevertheless, Coverage is invalidated in cases involving Alcohol/Drug Impairment or Excessive Speeding. In the event of damage and subsequent detection by local authorities such as the Caribbean Road Service or Police, indicating that the renter was operating the vehicle under the influence of alcohol or drugs or was engaging in excessive speeding, the renter shall assume complete responsibility for all damages to the vehicle and any associated damages for which the Company may be held liable.

 

  1. Accident

Should an accident occur, it is imperative that you remain at the accident scene and immediately contact the Caribbean Road Service (CRS) at +599 7177711 or +599 7179292. Please remain on-site until the arrival of CRS personnel, who will conduct an accident report at no cost to you. It is crucial to adhere to this procedure. Failure to remain at the scene may necessitate a reconstruction by CRS, incurring a cash payment of $100. It's important to note that without a CRS report, the renter will bear full responsibility for all vehicle damage, including any associated collateral damage, even in the case the renter has purchased the 100% Coverage Package.

 

  1. Cancellation and Changes

At 123 Car Rental, we understand that plans can change. We offer flexible cancellation options for your convenience:

8A. For Renters with Mandatory Collision Damage Waiver (CDW)

- Renters who have selected the mandatory Collision Damage Waiver (CDW) can cancel their reservation at any time.

- A non-refundable administrative fee of $75 will be deducted from the total refund amount.

- Renters have the option to keep the full amount as a deposit for future rentals.

 

8B. For Renters with the 100% Coverage Package

- Renters who have also purchased the 100% Coverage Package can cancel their reservation at any time.

- The full rental amount will be refunded.

- Renters also have the option to keep the full amount as a deposit for future rentals.

 

8C. Process for Cancellation

- To cancel a reservation, renters must contact our customer service team via phone or email and provide their reservation details.

- Refunds will be processed within 5 business days from the date of cancellation.

- Refunds will be issued to the original payment method used for the reservation.

- In the event of a no-show or failure to cancel a reservation, standard rental charges may apply.

 

  1. Child Seat Rental

For your convenience, we offer child seats available for rental. Please note that while we provide child seats, 123 Car Rental in not liable for any incorrect installation or use of the child seat. It is the sole responsibility of the renter to ensure the proper installation and use of the child seat for the safety of their child.

 

  1. Additional Drivers

The cost for adding an extra driver is $8 per person per day. The additional driver must meet our standard age and rental requirements. Only the primary renter and authorized "additional drivers" listed on the rental agreement are permitted to operate the vehicle. In the event of an accident and if the driver is not listed as the renter or an additional driver on the contract, the insurance coverage becomes invalid, and the renter becomes fully responsible for the total cost of any damages incurred.

 

  1. Vehicle Maintenance and Breakdowns

- The Company regularly maintains its vehicles to ensure safe and reliable operation.

  1. Lost Car Key

The enter shall assume full responsibility for a lost car key, even when the renter has opted for the 100% Coverage package. The fees for the replacement of car keys are as follows:

- Regular Car Key: USD 250
- Car Key with Remote Transmission: USD 350

 

  1. Incorrect Fuel Use

The renter is entirely responsible for any damage resulting from the use of incorrect fuel. even when the renter has opted for the 100% Coverage package. This includes, but is not limited to, filling a diesel engine vehicle with gasoline, or a gasoline engine vehicle with diesel. The charge for repairs related to incorrect fuel use is set at USD 500.

 

  1. Returning the Vehicle

14A. Vehicle Return Policy for Renters with the additional 100% Coverage Package

Zero Deposit and Zero Deductible

- Renters who have selected the 100% Coverage Package enjoy the benefit of zero deposit and zero deductible. This means that you are not required to provide a deposit, and you will not be responsible for any deductible amount in the event of damage to the rental vehicle.

Fuel Tank Requirement

- Renters are required to return the vehicle with a full tank of fuel. Failure to return the vehicle with a full tank of fuel will result in an additional fee of $25, plus the cost of fuel needed to fill the tank to its original level.

Inspection at Return

- The vehicle will be inspected upon return to assess its condition and fuel level.

Dispute Resolution

- If a renter disputes any charges related to vehicle fuel level, the matter will be investigated, and an appropriate resolution will be determined.

Acknowledgment

- By renting a vehicle with the 100% Coverage Package, renters acknowledge their understanding and agreement to these terms and conditions.

 

14B. Vehicle Return Policy for Renters with Collision Damage Waiver only (CDW)

Deposit and Deductible

- Renters with the mandatory Collision Damage Waiver (CDW) are required to provide a deposit of $500 at the time of vehicle pickup. This deposit is held as a security against any potential damages to the rental vehicle.

- In the event of damage to the vehicle, renters with CDW will be responsible for a deductible fee of $500.

Return in the Same Condition

- Renters are expected to return the vehicle in the same condition as it was rented. This includes the vehicle's physical condition, and the fuel tank level.

Additional Charges for Damages

- If the vehicle is returned with damages that require repair, the cost of repair up to the deductible amount of $500 will be charged to the renter. Any repair costs exceeding $500 will be covered by the mandatory CDW.

Fuel Tank Requirement

- Renters are required to return the vehicle with a full tank of fuel. Failure to return the vehicle with a full tank of fuel will result in an additional fee of $25, plus the cost of fuel needed to fill the tank to its original level.

Failure to Return in the Same Condition

- If the vehicle is not returned in the same condition as it was rented (including physical damage, or fuel level), the renter will be responsible for any associated charges.

Inspection at Return

- The vehicle will be inspected upon return to assess its condition, cleanliness, and fuel level.

Charges Assessment

- Any charges resulting from damages, cleaning, or fuel deficiency will be deducted from the $500 deposit. If the charges exceed the deposit amount, the remaining balance will be billed to the renter.

Dispute Resolution

- If a renter disputes any charges related to vehicle condition or cleanliness, the matter will be investigated, and an appropriate resolution will be determined.

Acknowledgment

- By renting a vehicle with the mandatory CDW, renters acknowledge their understanding and agreement to these terms and conditions.

 

  1. Privacy

- The Company respects your privacy and handles your personal information in accordance with applicable data protection laws. Please refer to our Privacy Policy for more information.

 

  1. Governing Law and Jurisdiction

- These Terms are governed by the laws of Bonaire, Caribbean Netherlands, and any disputes will be subject to the exclusive jurisdiction of the courts in Bonaire.

By using our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. If you do not agree with any part of these Terms, please do not use our services.
